The Canadian Traveler (www.thecanadiantraveler.ca) provides this site to users subject to the following terms of use. Through accessing and/or using the website you explicitly agree to comply with and be bound by the following terms and conditions. If you are not in agreement with the following terms please do not use this website.

The Canadian Traveler reserves the right to modify any of the terms contained herein, or any other site guideline, at any time. Changes are effective immediately upon posting and users who do not agree with amended terms must discontinue use of the site. Continued use of the site implies your acceptance of the modified terms. Acknowledging the potential dynamic nature of these Terms users are advised to review the Terms from time to time.

Ownership and Copyright

Except as otherwise indicated, the Site, and all content: text, images, logos and content contained within this site are the proprietary property of The Canadian Traveler. User contributions, photos, reviews, and otherwise become part of the site upon posting and the user agrees that they become property of The Canadian Traveler website. The Canadian Traveler nor its partners will never sell, trade, or otherwise distribute user generated content without the express consent of the user in question.

User Limited License

The Canadian Traveler grants its users a limited, non-transferrable or available for sublicense license to access the Site and to view, copy and print portions of its content. This license is subject to Site Terms and further pertains to the following: users may only view, copy and print site content for their own personal, non-commercial use.

Use of Forums, Image Gallery and Other Interactive Content

The Canadian Traveler is built around discussion forums and other user directed content in which users post reviews of their travel experience, or ask questions regarding travel. These areas are provided by The Canadian Traveler, and users are solely responsible for their use of these areas and use them at their own risk. Users must explicitly agree to not post, upload, transmit or otherwise distribute content in any area of thecanadianteaveler.ca any content which may be deemed objectionable, which includes, but is not limited to: Any data or other content that is unlawful, libellous, defamatory, obscene, pornographic, indecent, threatening, harassing, invasive of the rights of others or fraudulent. Content that constitutes, encourages, or provides information regarding the commission of criminal acts, violates the rights of any party, or that would otherwise create any liability or violate law. Content that infringes on any copyright, trademark, patent or any other intellectual or proprietary right of any party. Content that impersonates a person or misrepresents affiliation with a person or entity. Unsolicited promotion, advertising, or solicitation. Viruses, corrupted data or other harmful, disruptive or destructive files. Content that is unrelated to the topic under which it is listed, or irrelevant to the purpose of The Canadian Traveler. Content that is otherwise deemed objectionable by The Canadian Traveler and/or its partners, The Canadian Traveler reserves the right to edit, delete, or otherwise alter user content that it deems not in accordance with the Terms of Use or for any reason it deems necessary.

The Canadian Traveler assumes no responsibility nor liability for any content posted, stored or uploaded by users or any other third party. The Canadian Traveler will not be held liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, The Canadian Traveler is not liable for any representations or content generated by its users. Further, The Canadian Traveler will not be held liable for the result of any action based on information derived from interpretation or usage of any information posted on thecanadiantraveler.ca. Any use of this site in violation of the above violates Terms and may result in banning, suspension and termination of your rights to use of The Canadian Traveler. Users personal information will only be divulged to outside parties when necessary in order to cooperate with legitimate government requests, court orders or to ensure the integrity of The Canadian Travelers business. The right of The Canadian Traveler to do so will override any terms of it’s Privacy Policy.

Advertising

The Canadian Traveler will run third party advertising and promotions on this site. User interaction with these third parties are solely between the user and such third party. The Canadian Traveler assumes no responsibility or liability for any issues resultant of these interactions.

Users agree not to publish any content which may be deemed to be in violation of any copyright held by parties other than themselves.

Limitation of Liability

You waive and covenant not to assert any claims or allegations of any nature whatsoever against The Canadian Traveler, its affiliates, or their respective directors, officers, employees or agents arising out of or in any way relating to your use of the site, the services, the content or the materials contained in or accessible through the site, including, without limitation, any claims or allegations relating to the alleged infringement of proprietary rights, alleged inaccuracy or site content, or allegations that The Canadian traveler has or should indemnify you or any third party from any claim or allegation arising from use of the site. Users use the site at their own risk.

Without limitation of the foregoing, neither The Canadian Traveler nor any parties providing site content shall be liable for any direct, special, indirect of consequential damages, or any other damages of any contract, tort or otherwise, arising out of or in any way accessible through the site, including without limitation any damages caused by or resulting from your reliance on any site content or other information obtained from The Canadian Traveler or accessible via the site, or that result from mistakes, errors, omissions, interruptions, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorized access to The Canadian Traveler’s records, programs or services.

The Canadian Traveler operates out of its offices in and around Toronto, Ontario. As such, this site and its users agree to be governed by the laws of Ontario. You consent to the personal jurisdiction of the Ontario Provincial Court over you, and covenant not to assert any objection to proceeding in such courts. If you choose to access the site from locations other than Toronto, Ontario you will be responsible for complying with all local laws of the jurisdiction from which the site was accessed. The Canadian Traveler reserves the right without any notice or liability to you to terminate your license to use the site, or block/prevent your access to all or a portion o the site and its content; change, suspend or discontinue any aspect of the site, its content and services, and impose limits upon these when deemed necessary.
